Do you need a permit for a treehouse or playhouse?
Every search result says "it depends". It depends on two separate rule books, and both print real numbers: a building code exemption, often 64 sq ft and 8 ft or up to 200 sq ft, and a zoning limit on height and yard. Here are both, read from eight local codes.
Short answer
Often not, if it is small. The model residential code exempts swings and other playground equipment and one-story detached sheds up to 200 sq ft, and many cities write a smaller treehouse limit: 64 sq ft and 8 ft from floor to roof in Chino Hills and Long Beach. That exemption is only from the building permit. Zoning height, yard and setback limits still apply, and the treehouse cases that reach the news are lost on them.

The short answer
Often no building permit, if it is small, but always the zoning limits. The model residential code exempts "swings and other playground equipment" from a building permit1. It also exempts "one-story detached accessory structures" up to 200 sq ft1. Many California cities print a smaller rule just for treehouses. In Chino Hills and Long Beach it is 64 sq ft and 8 ft from floor to roof34.
That exemption is only half the answer. It frees you from a building permit. It does not free you from zoning, which sets how tall a structure can be and how close to the lot line it can sit. Long Beach writes it into the same sentence: the treehouse must not be "in violation of Title 21 zoning regulations"4. The treehouse fights that make the news are almost all zoning fights. The same split applies to swing sets and playsets, as permits, setbacks and HOA rules sets out.
Permit, zoning and accessory structure: the terms
Three terms do the work on this page.
A building permit is approval from the building department before you build. Its job is to check how a structure is built: footings, framing, wiring. Each city lists work that needs no permit, and that list is the exemption.
Zoning is a separate set of rules, usually run by the planning department. It says where a structure can stand and how big it can be: a height cap, a lot coverage limit, and setbacks. A setback is the minimum distance from a property line.
An accessory structure is a building on the lot that serves the house, like a shed or a detached garage. Treehouses and playhouses usually fall under it. The model code behind most of the rules here is the International Residential Code (IRC). Cities adopt it with their own changes, and its exempt list is section R105.2.
What the model code exempts
Federal Way, Washington, publishes the IRC R105.2 list as it applies there1. Four items on it matter for a play structure:
| IRC R105.2 item | Limit in the text |
|---|---|
| Swings and other playground equipment | No size limit given |
| One-story detached accessory structures | Floor area up to 200 sq ft |
| Decks | Up to 200 sq ft, no more than 30 in above grade, not attached to a house |
| Fences | Up to 6 ft high |
Two things follow. First, a raised treehouse floor is not an exempt deck. The deck item stops at 30 in above grade1, and a treehouse floor is usually several feet up. Second, the list never says whether a treehouse counts as playground equipment or as an accessory structure. Your building official decides which item applies. Federal Way adds that "separate permits may be required" for the exempt items1. Dublin, California, spells out the point: exemption "shall not be deemed to grant authorization" for work that breaks "any other law, ordinance, rule or regulation"5.
The IRC list and eight local codes, side by side
These are the rules as each city or county publishes them. The building limit is in the second and third columns. The zoning limit, which applies even when no permit is needed, is in the last.
| Place | Treehouse | Playhouse | Zoning still applies |
|---|---|---|---|
| Federal Way, WA (IRC list) | Not named; detached structures up to 200 sq ft exempt | Not named; same 200 sq ft item | Separate permits may be required |
| Winnetka, IL | No building permit if held up only by trees | Permit required | Treehouse 15 ft with roof or walls, 35 ft open, not in a required front or side yard; playhouse 7 ft, 6 to 12 ft side setback |
| Chino Hills, CA | Exempt up to 64 sq ft, 8 ft floor to roof, 16 ft from grade | Not named in the list | Not set out in the exempt list |
| Long Beach, CA | Exempt up to 64 sq ft, 8 ft floor to roof | Same limit | Must meet Title 21 zoning; no wiring or plumbing |
| Dublin, CA | Tree houses exempt, no size given | Exempt up to 120 sq ft, one story | Wiring and plumbing need permits |
| Sammamish, WA | No permit up to 200 sq ft if used for storage; one-story tree-houses let off the 12 ft cap | Same: 200 sq ft, 12 ft, storage use | 10 ft side and rear setback in R-1 to R-8 |
| Happy Valley, OR | Permits from 200 sq ft | Permits from 200 sq ft | 3 ft side and rear setback if 14 ft or lower |
| Los Altos, CA (2020 case) | 24 ft tree house held to the accessory limit | Not covered in the case | 12 ft accessory structure height |
| Fairfax County, VA (2022 case) | Platform about 10 ft up | Not covered in the case | No treehouse or accessory structure in a front yard |
The common city limit for a treehouse is 64 sq ft. That is a floor 8 ft by 8 ft. Chino Hills ties it to a house: the treehouse must be accessory to an R-3 occupancy, which means a one- or two-family home3. Long Beach also bars plumbing, electrical and mechanical work4. Dublin goes the other way and exempts "tree houses" and "other structures which are designed to be used by children for play" with no size at all5. It also exempts "swings and other playground equipment" at one- and two-family homes, and a one-story building for "playhouses and similar uses" up to 120 sq ft5.
Winnetka is the only code here that splits the two by support. A treehouse is "supported solely and entirely by one or more trees", and it needs no building permit2. A playhouse is "fully or partially supported by the ground and enclosed by walls and a roof", and it does2. Winnetka also bars water and electricity in a treehouse2. Its zoning limits apply either way. A treehouse can be 15 ft tall with a roof or walls, or 35 ft as an open platform, and cannot stand in a required front or side yard2. A playhouse can be 7 ft tall and must stay out of the side yard setback, 6 to 12 ft from the line depending on the district2.
One treehouse, walked through seven codes
Take a treehouse 6 ft by 8 ft, so 48 sq ft. It has walls and a roof. The floor is 7 ft up, and the roof peak is 6 ft above the floor, so the top is 13 ft from the ground. It is bolted to one tree, with two posts at the outer corners. It sits in the rear yard, 5 ft from the side lot line. Read against each code, that gives:
- IRC list, Federal Way. 48 sq ft is under the 200 sq ft accessory structure limit, so no building permit1. The deck item does not help, since the floor is far above 30 in.
- Chino Hills. 48 sq ft is under 64. Floor to roof is 6 ft, under 8. The top is 13 ft, under 16. Exempt3.
- Long Beach. Under 64 sq ft and 8 ft floor to roof, so exempt, as long as it meets zoning and has no wiring4.
- Dublin. Tree houses are exempt, with no size test5.
- Winnetka. The two posts change everything. A treehouse must be held up only by trees, so this one counts as a playhouse. That needs a permit, and a playhouse can be only 7 ft tall2. At 13 ft it fails. Take the posts away and hang it from the tree alone: no building permit, and 13 ft is under the 15 ft cap for a roofed treehouse2.
- Sammamish. Under 200 sq ft, and a one-story tree-house is let off the 12 ft cap6. The no-permit list also asks for a site clear of critical areas and a structure "used for storage"6, so ask whether a treehouse qualifies. Either way, the side and rear setback in R-1 to R-8 is 10 ft, and this one is 5 ft from the line. The city lets a side or rear setback drop to 5 ft with a signed agreement from the neighbor, recorded with the county6. If a 10 ft setback leaves little room, small yards covers what fits.
- Happy Valley. Under 200 sq ft, so no permit. At 14 ft or lower, the side and rear setback may drop to 3 ft, so 5 ft passes7.
So the same treehouse needs no building permit in five places, and Sammamish's storage condition is a question for the city. It fails Winnetka's playhouse height and Sammamish's setback. Both failures come down to where it stands and how it is held up, not how it is built.
Why "it depends" and "no permit needed" both circulate
Both answers come from the same split. Forum posts say treehouses need no permit, and for a small one under many building codes that is true. The cases that end badly are zoning cases.
In Los Altos, California, a family built a tree house 24 ft tall, with a 105 sq ft deck and 210 sq ft of enclosed space89. They said they had been told "there are no codes regulating tree houses"8. The city ruled it an accessory structure, not a playhouse, with a height limit of 12 ft8. In August 2020 the city council gave the family four months to reduce it9.
In Fairfax County, Virginia, a family put a platform with railings about 10 ft up in their front yard, because the backyard trees were too small. The county's zoning ordinance bars treehouses and other accessory structures from front yards10. In February 2022 the Board of Zoning Appeals voted 6 to 1 to deny the variance, so the family could not keep it10.
Neither case turned on a building permit. Both turned on height or yard.
Where this stops applying
This page covers the building permit and zoning for a small play structure at a house. It does not cover wiring, lights or water. Dublin and Long Beach both send those to their own permits45, and Winnetka bans them in a treehouse2. Work in wetlands, streams or other critical areas is treated differently: Federal Way keeps permits for it, and Sammamish's exemption needs a site free of them16. Larger treehouses can need more than a permit. Happy Valley asks for an arborist's report and engineering calculations for those over 200 sq ft or 14 ft7. HOA covenants are a third rule book, with their own approval process and height limits.
The table shows the pages each city published when this was written, and codes are revised. Eight places are not your place, so ask your own building and planning departments the four questions above. No permit also does not mean safe. A 7 ft floor is a 7 ft fall height, and that needs a guarded edge and protective surfacing below, as treehouses and playhouses explains.
What to do next
Settle the size and height first, then call the planning counter with numbers. A floor under 64 sq ft, a roof under 8 ft above it and a top under 16 ft from the ground clear the treehouse limits in Chino Hills and Long Beach. Decide early between tree support and posts, since Winnetka treats the two as different things. Fall height and use zones shows how the floor height sets the surfacing, and guardrails and barriers covers the edge. If you are building from plans, building a playset yourself covers structural sizing. If a crew is building it, put permits and setbacks in the contract, as choosing an installer explains. For a ground level playhouse instead, playhouses and dramatic play covers what children do with one, and insurance and risk management covers telling your insurer.
Frequently asked questions
Do you need a permit to build a treehouse?
Often not for a small one. Chino Hills and Long Beach exempt a treehouse up to 64 sq ft and 8 ft from floor to roof, Dublin exempts tree houses outright, and Winnetka needs no building permit for one held up only by trees. The exemption covers the building permit alone. Zoning limits on height and yard still apply, and wiring needs its own permit.
Do you need a permit for a kids playhouse?
Often not for a small one, and the limits are printed. Dublin exempts a one-story playhouse up to 120 sq ft and Long Beach one up to 64 sq ft and 8 ft floor to roof. Winnetka requires a building permit for every playhouse, caps it at 7 ft tall and keeps it out of the side yard setback. A small prefab playhouse under those limits usually needs none.
Is a treehouse playground equipment under the building code?
The model code does not say. Its exempt list, IRC R105.2, names swings and other playground equipment and one-story detached accessory structures up to 200 sq ft, but not treehouses. Some cities answer it in their own code: Dublin lists tree houses or other structures designed for children's play, and Chino Hills and Long Beach give a treehouse its own 64 sq ft limit.
How tall can a treehouse be without a permit?
In the codes compared here: 8 ft from floor to roof and 16 ft from the ground in Chino Hills, 8 ft floor to roof in Long Beach, and in Winnetka 15 ft from the ground with a roof or walls and 35 ft as an open platform. Los Altos held a 24 ft tree house to its 12 ft accessory structure limit in 2020.
What happens if you build a treehouse without a permit?
The cases that reach the news are zoning cases. Los Altos stopped work on a 24 ft tree house and in 2020 gave the family four months to bring it down toward its 12 ft limit. In 2022 Fairfax County's zoning appeals board refused, 6 to 1, to let a family keep a treehouse in their front yard.
